- Any third-party costs (such as software licences, data purchases or subcontracted specialist work) will be disclosed and approved by you before they are incurred.
5. Client Responsibilities
You agree to provide accurate, complete and timely information and materials reasonably required for us to perform the services. You confirm you have all necessary rights, permissions and authority to share any information you provide to us. Delays caused by late or incomplete information may affect delivery timelines and may result in additional fees.
6. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth), including consumer guarantees that services will be provided with due care and skill, be fit for purpose, and be delivered within a reasonable time. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. If our services do not meet these guarantees, you may be entitled to a remedy such as re-supply of the services or compensation.
7. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for any indirect, incidental, special or consequential loss, including loss of profit, revenue, goodwill or data, arising from the services or use of the Website.
- Our total aggregate liability for any claim arising out of or relating to the services is limited to the fees paid by you for the relevant service, except where such limitation is not permitted by the Australian Consumer Law.
- Nothing in this clause limits liability for death, personal injury, fraud, or any liability that cannot lawfully be excluded.

We retain ownership of our pre-existing methodologies, tools, templates and know-how.
9. Confidentiality
Both parties agree to keep confidential all non-public information received from the other party in connection with the services, and to use such information only for the purpose of performing the engagement. This obligation survives the completion or termination of any engagement.

We handle personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
11. Website Use
- You must use the Website lawfully and must not attempt to interfere with its operation, introduce malicious code, scrape content, or misrepresent your identity.

Upon termination, you remain liable for fees for services performed up to the date of termination. We may suspend or terminate access to the Website immediately if you breach these Terms.
13. Force Majeure
We are not liable for delays or failure to perform obligations caused by events beyond our reasonable control, including natural disasters, pandemics, industrial action, power or telecommunications failures, or acts of government.
14. Dispute Resolution and Governing Law
If a dispute arises, both parties agree to first attempt to resolve it through good-faith negotiation.
